The subject matter derives from the case law of three judicial instances: Supreme and Constitutional Courts of Slovenia and, more generally, from the rapidly advancing jurisprudence of the European Court of Human Rights (ECtHR) in Strasbourg. Former judge of the Constitutional Court, and presently Justice of the Supreme Court, Mr. Jan Zobec will cover the latter, and Prof. Zupančič, former judge of the Constitutional Court and for 18 years judge of the ECtHR will cover the case law of the ECtHR. To a large extent all these jurisprudences overlap.

The rigorous teaching approach will be the Harvard Socratic method, the give-and-take between the teacher and the students. Apart from this, the theoretical aspects will be covered by the book ON THE EUROPEAN COURT OF HUMAN RIGHTS (Eleven Publishing, Utrecht, 2019) authored by prof. Zupančič, and for the constitutional law THE COMMENTARY OF THE CONSTITUTION OF THE REPUBLIC OF SLOVENIA (KURS 2019). In order to enable an interesting classroom dialogue, the Socratic method presupposes advance preparation and the recital of cases. This will enable the students to acquire the practical knowledge enabling them to interpret the relevant cases and file actions before all three judicial instances.

This is an optional course and designed as a substantive supplement to the elective course Economic and Social Justice: Domestic and International Perspectives. All students, both undergraduate and Master of Business Studies, are invited to participate in the course.
